well that's not totally correct because Modalities in Study (0008,0061) is
defined as an optional Q/R attribute (see section C.3.4 in DICOM PS 3.4).
However, since it optional, an Q/R SCU can not rely on that it is really
supported by the SCP. Details regarding the handling of optional keys for
Query/Retrieve can be found in section C.2.2.1.3 of DICOM PS 3.4.

Btw, as far as I know, Modalities in Study is no "IHE invention" but has
been introduced some years before with DICOM CP 71:

What's true about it is that Modalities in Study is required for both SCU
and SCP as part of the IHE Query Images transaction [RAD-14], i.e. Image
Archive and Image Display actors.
